These Terms of Service (TOS) govern your use of the BIP Messages application and the messagebe.com website, published by KLARO APP. By accessing or using the service, you agree to be bound by these TOS.
1. Acceptance
Use of the service implies full acceptance of these TOS. If you do not accept any clause, you must refrain from using the service. KLARO APP reserves the right to modify the TOS at any time; modifications will take effect 30 days after notification in the application.
2. Service description
BIP Messages is an instant messaging and audio/video calling service, accessible via iOS, Android applications and the website. The service allows the exchange of text, voice, audio, video messages, files and the placing of calls over the Internet, all protected by end-to-end encryption.
3. Account creation
Use of the service requires creating an account with a valid phone number. You must be at least 16 years old to create an account. You are responsible for the confidentiality of your credentials and for all activities carried out from your account.
You undertake to provide accurate information and to keep it up to date. Providing false or misleading information may result in immediate account suspension.
4. Acceptable use
You agree to use BIP Messages in compliance with applicable laws and regulations. It is strictly prohibited to:
- Send illegal, hateful, violent, pornographic, defamatory content or content infringing the rights of others.
- Distribute spam, unsolicited advertising or chain messages.
- Use bots, scrapers or any automated system without prior written authorization.
- Attempt unauthorized access to our systems or other users' accounts.
- Impersonate another person or entity.
5. User content
You retain all intellectual property rights to the content you share via the service. You grant us only the technical license strictly necessary for routing your messages.
BIP Messages does not read, store and cannot access the content of your conversations due to end-to-end encryption. You are solely responsible for the content you share.
6. BIP intellectual property
The application, the site, the logos, trademarks and all elements of the service are the exclusive property of KLARO APP. Any unauthorized reproduction, modification or exploitation is prohibited and may be subject to legal proceedings.
7. Availability
We strive to ensure 24/7 service availability, but cannot guarantee uninterrupted availability. The service may be temporarily suspended for maintenance, updates or force majeure. We are not responsible for interruptions related to your Internet provider or device.
8. Limitation of liability
The service is provided "as is". To the fullest extent permitted by Belgian law, KLARO APP disclaims all express or implied warranties, including warranty of fitness for a particular purpose.
KLARO APP cannot be held liable for indirect, intangible or consequential damages (loss of data, loss of profit, loss of business opportunity) resulting from the use or inability to use the service.
9. Termination
You may delete your account at any time from the application settings. We reserve the right to suspend or terminate your account in case of violation of these TOS, in particular the acceptable use rules.
10. Changes
These TOS may be updated to reflect changes to the service or legislation. The applicable version is the one in force on the date of your use. Substantial changes are notified 30 days before they take effect.
11. Applicable law and jurisdiction
These TOS are governed by Belgian law. Any dispute relating to their interpretation or execution shall be subject to the exclusive jurisdiction of the courts of the judicial district of Namur, subject to mandatory consumer protection provisions.
